Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the GOPulse mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Your continued use of the App constitutes acceptance of any updates to these Terms.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Service Description

GOPulse is a mobile application developed by NorthStack Labs Inc. that provides GO Transit train tracking, departure information, journey planning, service alerts, and departure notifications. GOPulse is not affiliated with, endorsed by, or sponsored by Metrolinx, GO Transit, or any government agency. Transit data is sourced from publicly available Metrolinx Open Data APIs. Map services are provided by Google Maps. The App relies on third-party services for backend infrastructure, push notifications, subscription management, and error monitoring.

4. Not Official Transit Advice

GOPulse is an independent information tool and does not provide official transit advice or services. The App is not a substitute for official GO Transit communications and should not be used as the sole basis for time-critical travel decisions. For safety-critical or time-sensitive travel plans, always verify schedules and service status directly with GO Transit (gotransit.com or the GO Transit customer service line). NorthStack Labs Inc. assumes no responsibility for decisions made based solely on information displayed in the App.

5. Service Availability & Modifications

NorthStack Labs Inc. may modify, update, suspend, or discontinue the App or any of its features at any time, with or without notice. We are under no obligation to maintain, support, or update the App, or to provide any particular feature set. If we make material changes that affect paid subscribers, we will make reasonable efforts to provide advance notice. You acknowledge that the App relies on third-party services and APIs that may experience outages or changes beyond our control.

6. Account Registration & Responsibilities

To access the App's features, you must create an account using your email address, Google account, or Apple ID. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to: (a) provide accurate and complete registration information; (b) maintain and promptly update your account information; (c) notify us immediately of any unauthorized access to or use of your account; and (d) not create more than one account per person.

7. Account Deletion

You may delete your account at any time from the App's settings screen. When you delete your account, all associated data is permanently removed from our systems, including your profile, saved journeys, reminders, notification preferences, and device tokens. This action is irreversible. If you used Sign in with Apple or Google, deleting your GOPulse account will revoke the App's access to your Apple ID or Google account credentials. Active subscriptions must be cancelled separately through your device's subscription settings (Apple App Store or Google Play Store) to prevent continued billing.

8. Acceptable Use

You agree to use the App only for its intended purpose of accessing transit information. You must not: (a) reverse-engineer, decompile, or disassemble the App; (b) attempt to gain unauthorized access to our servers, systems, or other users' accounts; (c) use the App for any unlawful purpose; (d) interfere with or disrupt the operation of the App or its infrastructure; (e) use automated tools to scrape or extract data from the App; or (f) redistribute, sublicense, or resell access to the App.

9. Transit Data Disclaimer

Transit schedules, real-time vehicle positions, delays, platform assignments, and service alerts are provided by the Metrolinx Open Data API and are displayed on an "as-is" and "as-available" basis. GOPulse does not guarantee the accuracy, completeness, reliability, or timeliness of any transit data. Data may be delayed, incomplete, or contain errors beyond our control. Always verify critical travel plans with official GO Transit channels (gotransit.com or the GO Transit customer service line). GOPulse is not responsible for missed connections, delays, incorrect fare information, or any inconvenience resulting from reliance on information displayed in the App.

10. Subscriptions & Auto-Renewal

GOPulse offers optional premium features through an auto-renewable subscription called "GO Pulse+". By subscribing, you acknowledge and agree to the following: • Subscription length: GO Pulse+ is offered as a monthly or annual auto-renewable subscription. • Free trial: New subscribers may be eligible for a 7-day free trial. At the end of the trial period, your subscription will automatically convert to a paid subscription unless cancelled at least 24 hours before the trial ends. • Billing: Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. • Price: The subscription price is displayed on the purchase screen. Prices may vary by region and are subject to change. • Cancellation: You may cancel your subscription at any time through your device's subscription settings (Settings > Apple ID > Subscriptions on iOS, or Google Play Store > Subscriptions on Android). Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods. • Features: GO Pulse+ provides access to premium features as described on the subscription purchase screen. Feature availability may change over time. • Refunds: Refund requests are handled by Apple (App Store) or Google (Play Store) in accordance with their respective refund policies.

11. Location Services

The App may request access to your device's location services to show nearby stations and display live train positions on the map. Location access is optional and the App will function without it, though some features will be limited. You can enable or disable location access at any time through your device's settings. Your location data is used only within the App and is not stored on our servers or shared with third parties, except as needed to display map content via Google Maps.

12. Push Notifications

The App may send push notifications for departure reminders and service disruption alerts. Notifications are optional and require your explicit permission. You can manage notification preferences within the App and through your device's system settings at any time.

13. Intellectual Property

The App, including its design, code, graphics, user interface, and original content (excluding third-party transit data and map content), is the property of NorthStack Labs Inc. and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control.

14. Third-Party Services

The App integrates with third-party services that are subject to their own terms of service and privacy policies. By using the App, you also agree to comply with the terms of these services: • Google Maps: Subject to Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy. • Apple/Google: In-app purchases and subscriptions are subject to Apple Media Services Terms and Conditions or Google Play Terms of Service, as applicable. We are not responsible for the practices or policies of any third-party service provider.

15. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or reliability of any transit data, schedule information, or other content available through the App.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NorthStack Labs Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from: (a) your use of or inability to use the App; (b) any errors, inaccuracies, or omissions in transit data; (c) missed connections, delays, or travel disruptions; or (d) unauthorized access to your account. Our total aggregate liability for any claim arising from the App shall not exceed the amount you paid for in-app purchases in the twelve (12) months preceding the claim, or ten Canadian dollars (CAD $10.00), whichever is greater.

17. Force Majeure

NorthStack Labs Inc. shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond our reasonable control. This includes, but is not limited to: natural disasters, acts of government, internet or telecommunications infrastructure failures, third-party API or service outages (including Metrolinx, Google Maps, or cloud infrastructure providers), power failures, cyberattacks, pandemics, or labour disputes.

18. Indemnification

You agree to indemnify and hold harmless NorthStack Labs Inc. from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

19. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may terminate your use of the App at any time by deleting your account and uninstalling the App. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Force Majeure, Indemnification, Governing Law, Severability, and General Provisions) shall survive.

20. Apple & Google App Store Terms

These Terms are between you and NorthStack Labs Inc. only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Apple and Google are not responsible for the App or its content. Apple and Google have no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to applicable warranties, you may notify Apple or Google for a refund of the purchase price (if applicable); beyond that, Apple and Google have no warranty obligation. Apple and Google are not responsible for addressing any claims relating to the App, including product liability, regulatory compliance, or intellectual property infringement claims. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

21. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where practicable, by providing notice through the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the App and delete your account.

22. Governing Law & Dispute Resolution

Before filing any formal claim or proceeding, you agree to first contact us at gopulse@northstacklabs.ca and allow thirty (30) days to attempt to resolve the dispute informally. Most concerns can be resolved quickly through direct communication. These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the App that cannot be resolved informally shall be resolved exclusively in the courts located in the Province of Ontario, Canada, and you consent to the personal jurisdiction of such courts.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

24. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and NorthStack Labs Inc. regarding your use of the App and supersede any prior agreements or understandings. • Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it at a later time. • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. NorthStack Labs Inc. may assign its rights and obligations without restriction. • Electronic Communications: By using the App and providing your email address, you consent to receiving communications from us electronically, including via email and in-app notifications. You agree that all agreements, notices, and other communications provided electronically satisfy any legal requirement that such communications be in writing. • Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.
